Please note, as described in more detail below, this Privacy Policy does not apply to Personal Data we process on behalf of our Clients through or in connection with the services we provide to them, including, without limitation, those that are provided through or accessible from our websites (collectively, our “Services”).

OUR ROLES AND RESPONSIBILITIES

 

We obtain and process Personal Data in different capacities. When we collect or process Personal Data for our own purposes, meaning that we determine how and what Personal Data is processed, we are the data controller. This Privacy Policy applies to our collection, use, disclosure, and protection of Personal Data where we are the data controller.

 

When we process Personal Data on behalf of the business entities that utilize our Services (our “Client”), our Clients are the data controller with respect to that Personal Data and we are the data processor. As a data processor, we only process Personal Data on behalf of our Clients based on their instructions, including how they use the Services. This Privacy Policy does not apply to our collection, use, disclosure, or protection of Personal Data where we are the data processor because we do not control what Personal Data may collection in connection with their use of the Services or how they will use it. Instead, our Clients control what Personal Data we collect on their behalf and the purposes for which we process that Personal Data. For this reason, any Personal Data we collect or process on behalf of our Clients in connection with the Services are covered by our Clients’ applicable privacy policies and notices.

 

For clarity, we are the data processor, and our Clients are the data controllers with respect to the Personal Data and other information concerning our Clients’ patients that are collected, generated, and otherwise processed through or in connection with our Clients’ access to and use of our Services.

 

PERSONAL DATA COVERED BY THIS PRIVACY POLICY

 

When we refer to “Personal Data” in this Privacy Policy, we are referring to any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual. Please note, for purposes of this Privacy Policy, Personal Data does not include publicly available information.

Personal Data does not include information that is aggregated, anonymized, or deidentified in a way that cannot be used to identify a particular individual (“Deidentified Data”). We may use and disclose Deidentified Data in connection with our Operations for any lawful purposes, which may include purposes not described in this Privacy Policy. We commit to maintaining Deidentified Data in its deidentified form and not to attempt to reidentify the Deidentified Data, except and solely for the purpose of determining whether our deidentification processes satisfy the requirements of applicable laws.

The categories of Personal Data we collect and use in connection with your access to, use of, or interaction with our Operations may fall into one or more of the categories described below. Please note, the types of Personal Data within each category below are provided as examples of the types of Personal Data within each category and are not a representation that we will actually collect that the specific type of Personal Data from or about you.

 

  • Identifiers, such as your real name, alias, email address, IP address, account name, and other similar identifiers.

    Non-Sensitive Geolocation Information, such as the city, state, and ZIP code associated with an Internet Protocol address and other similar imprecise location information.
  • Professional or Employment-Related Information, such as your current employer, job title, and other similar information.

SOURCES OF PERSONAL DATA COLLECTED

 

From You

A large portion of the Personal Data we collect from or about you in connection with our Operations is collected directly from you or in connection with your access to, use of, or interaction with our Operations (including Personal Data we automatically collect). You have the option not to provide any Personal Data we ask you to provide in connection with your access to, use of, or interaction with our Operations. However, there are some features of our Operations where we have to collect certain Personal Data, and, if you do not provide us with the required Personal Data, you will not be able to access, use, or interact with that feature.

 

From Third Parties

We may also receive information (which may include Personal Data) about you from third parties, including, without limitation, online and offline sources, social media platforms, advertising networks, or other public or commercial sources, which may include, without limitation, the following categories of third parties:

  • Social Media Platforms – This category includes social media platforms owned or operated by third parties, such as Facebook, Instagram, LinkedIn, Twitter, and YouTube, where we maintain a social media account or where you otherwise interact with us or share our content.
  • Transactional Third Parties – This category includes third parties who are not related to us but provide us with Personal Data necessary to enable us to provide you with certain features and functionalities of our Operations.
  • Service Providers – This category includes third parties that provide services to us related to the functionality and operability of our Operations, such as hosting the online portions of our Operations, managing communications we send and receive, and processing orders and payments.
  • Targeted Advertising Partners – This category includes third parties that facilitate the delivery of our targeted advertisements, promotions, and offers.
  • Analytics Providers – This category includes third parties that operate tracking technologies, such as web beacons, cookies, clear gifs and pixel tags on the online portions of our Operations to collect information used to analyze the use and performance of our Operations, including, among other things, measuring the effectiveness of our Operations, content, communications, and advertising.

USES OF PERSONAL DATA COLLECTED

 

The primary purposes for which we use Personal Data we collect or receive through or in connection with our Operations are:

 

  • Customer Service and Communications – We may use Personal Data to: (1) provide customer service and support; (2) respond to your requests for information about our Operations or Services; (3) call or email you with alerts and updates about our Operations or Services; and (4) administer surveys or otherwise obtain feedback from you.

  • Law Enforcement/Legal Purposes – We may use Personal Data to cooperate with law enforcement or for other legal purposes, including to: (1) comply with legal and regulatory requirements; (2) cooperate with law enforcement or other governmental agencies for the purposes of investigations, public safety, or matters of public importance where we are legally required to do so or believe that disclosure of Personal Data is necessary or appropriate to protect the public interest; and (3) protect and defend against legal actions or claims.

RETAINING PERSONAL DATA COLLECTED

 

We retain Personal Data for only as long as we have a legitimate business purpose to keep it. These purposes may include retaining Personal Data to:

  • complete the transaction for which the Personal Data was collected;
  • continue our ongoing business relationship with you or our applicable customer;
  • ensure the security and integrity of our Operations; and
  • satisfy any legal, regulatory, tax, accounting, or reporting requirements.

To determine the appropriate retention period for individual categories of Personal Data we collect, we consider the nature and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of the Personal Data, the purposes for which we process that Personal Data and whether we can fulfill those purposes through other means, and applicable legal, regulatory, tax, accounting, reporting, or other requirements.

 

DISCLOSING PERSONAL DATA TO THIRD PARTIES

 

In order to conduct our Operations, comply with our obligations under applicable laws and agreements, we may disclose your Personal Data to certain third parties, including, without limitation, the following categories of third parties:

  • Service Providers – We may disclose Personal Data to our service providers, including, without limitation, the third parties that provide services to us related to marketing, hosting the online portions of our Operations, payment processing, and fraud protection and prevention. We use HubSpot to make our Live Chat feature available to you, and we may save your transcripts on HubSpot’s platform. HubSpot may not use those transcripts for their own use.
  • Marketing Partners – We may disclose Personal Data to third parties that facilitate the delivery of targeted ads, promotions, and offers on and off the online portions of our Operations.
  • Parties to Business Transactions – In the event of an anticipated or actual merger or acquisition, bankruptcy or other sale of all or a portion of our assets, we may transfer or allow third parties to use information owned or controlled by us, including Personal Data. We reserve the right, in connection with these types of transactions, to transfer, disclose, assign, or sell your Personal Data and other information we have collected to third parties or to authorize such third parties to use any such information including for due diligence as part of any of the transactions described in this paragraph. Any Personal Data you submit or that is collected after this type of transfer may be subject to a new privacy policy adopted by the successor entity.
  • Government and Law Enforcement – We may disclose your Personal Data to individuals or private parties where necessary to enforce and comply with the law, to protect our property or legal rights, for the safety of the public or any person, to prevent harm, and to protect the security and integrity of our Operations.
  • Professional Advisors – We may disclose your Personal Data to our professional advisors, such as our attorneys, accountants, financial advisors, and business advisors, in their capacity as advisors to us.
  • Others – We may disclose your Personal Data to any other third party upon your request or with your express consent to do so.

ANALYTICS TOOLS WE USE

 

We may use, or permit the use of, analytics tools and other tracking technologies on the online portions of our Operations that, subject to your choices and any exercise of rights available to you, may collect information about you or your device in connection with your access to, use of, or interaction with the online portions of our Operations. These analytics tools and other tracking technologies may include, without limitation:

  • Cookies and Other Tracking Technologies – We may use cookies and other tracking technologies, including pixel tags and web beacons, to gather more information about how the online portions of our Operations are accessed, used, or otherwise interacted with. A “cookie” is a small text file that is saved on your computer or device when you access, use, or interact with the online portions of our Operations, which allows the online portions of our Operations to remember your actions and preferences and recognize you or your browser or device. Web beacons and pixel tags are small graphics on a webpage that monitor activity when viewing a webpage. We use these tools to learn whether the online portions of our Operations are operating optimally, learn whether you are a repeat visitor to the online portions of our Operations, personalize advertising, obtain valuable data and statistics about the usage and effectiveness of the online portions of our Operations, and help us provide an enjoyable, personalized, and innovative online experience for you. We may combine information gathered from these cookies and other tracking technologies with other Personal Data. Generally, the type of information we collect through cookies and other tracking technologies is specific to your computer or other device and includes the date and time a device accessed the online portions of our Operations; what parts of the online portions of our Operations were accessed and if they were delivered successfully; and the IP address, internet service provider, device ID, approximate geographic location, and browser type of a device that accesses the online portions of our Operations.   • Analytics, Interest-Based Advertising Tools, and Session Replay Tracking Tools – The online portions of our Operations may include certain analytics, advertising, and session replay tracking tools provided or operated by third parties, including:
    • Google Analytics and Google’s Advertising Tools – Google Analytics is a web analytics tool that assists us in understanding how certain online portions of our Operations are used. Google Analytics will place cookies on your device that will generate information we select about your use of the online portions of our Operations, including the IP address of devices that access certain online portions of our Operations. That information will be transmitted directly to and stored by Google. The information will be used for the purposes of evaluating use of the online portions of our Operations, compiling reports on activity on the online portions of our Operations for our use, and providing other services relating to activity on, and usage of, the online portions of our Operations. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google’s practices with respect to the information collected through Google Analytics are covered by Google’s privacy policy. We also use the following Google Analytics advertising features: Dynamic Remarketing with Google AdService, Google Dynamic Remarketing, and DoubleClick. To prevent this data from being used by Google Analytics, follow the instructions to download and install the Google Analytics Opt-Out Browser Add-On for each web browser you use. Using the Google Analytics Opt-Out Browser Add-On will not prevent us from using other analytics tools. Opting out will not affect your use of the online portion of our Operations.
    • HubSpot Analytics – HubSpot Analytics is a web analytics tool that assists us in understanding how certain online portions of our Operations are used. HubSpot Analytics utilizes various tracking technologies to generate information we select about your use of the online portions of our Operations, which may include information about websites or online service visited before a device accesses the online portions of our Operations, metrics about the performance of the online portions of our Operations, and information about how devices access the online portions of our Operations. That information will be transmitted directly to and stored by HubSpot. The information will be used for the purposes of evaluating use of the online portions of our Operations for our use and providing services relating to activity on, and usage of, the online portions of our Operations.     • Facebook (Meta) Custom Audiences – We use the remarking services of Facebook (Meta, Inc.) on the online portions of our Operations. We use Facebook Custom Audiences to deliver targeted advertising to visitors to the online portions of our Operations across Meta-owned social media platforms based on email addresses we have collected and other identifiers.     • Hotjar – We use a session tracking replay software called Hotjar to help us better understand users’ experience on the online portions of our Operations (e.g., how much time they spend no which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain the online portions of our Operations. Hotjar’s session tracking replay software uses cookies and other technologies to collect information about how users navigate and use the online portions of our Operations in real-time. This information may include the date and time you visited the online portions of our Operations, mouse clicks, mouse movements, keystrokes and text input, scrolling, webpage or content loading times, site errors, device IP address, device screen size, device type, browser information, geographic location, and the preferred language used to display the online portions of our Operations. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden from selling any of the data they collect on our behalf.     • Microsoft Ads – We use Microsoft Ads (formerly known as Bing Ads), an online marketing service provided by Microsoft, to display search advertisements and to track when users have visited the online portions of our Operations via a Microsoft Ads advertisement. If you click on a Microsoft Ads advertisement, Microsoft Ads stores a cookie on your device that is used to track the number of individuals who click on a Microsoft Ads advertisement and are forwarded to the applicable website. HOW TO MANAGE YOUR PERSONAL DATA

THIRD PARTY PLATFORMS AND OTHER SITES

 

We are active on various Third Party Platforms, including Facebook, Instagram, LinkedIn, Twitter, and YouTube. Anything you post on a Third Party Platform is public information and will not be treated confidentially. We may post (or re-post) on the online portions of our Operations any comments or content that you post on our pages on Third Party Platforms. The collection and use of Personal Data by Third Party Platforms is governed by the applicable privacy policies and notices of the third parties that own and operate those Third Party Platforms and not by this Privacy Policy. We encourage you to review those policies and notices before using any Third Party Platform or related features provided through the online portions of our Operations.

Additionally, the online portions of our Operations may link to, or be linked to from, websites not owned or controlled by us. We are not responsible for third parties’ privacy policies or practices. This Privacy Policy does not apply to any third-party websites or to any data that you provide to third parties. CHILDREN’S PRIVACY

 

We do not target or direct our Operations at children under the age of 18. If we learn that we have collected the Personal Data of anyone under the age of 18, we will take appropriate steps to delete this information.
